How to Avoid Predatory Lenders: A 2026 Borrower's Checklist

The nine red flags that identify a predatory lender before you sign anything. Print this and keep it near your desk.

Predatory lending has evolved. It's no longer just storefront loan sharks — it's now sophisticated online sites that look identical to legitimate lenders until you notice the small details. Here's the 2026 checklist.

The 9 red flags

1. Any request for money BEFORE funding. Legitimate lenders deduct their origination fee from your loan proceeds. They NEVER ask you to send money, gift cards, or crypto in exchange for "unlocking" your loan. This is the #1 sign of an advance-fee scam.

2. "Guaranteed approval regardless of credit." State law requires underwriting on every consumer loan. Any lender promising "guaranteed approval" is either lying or unlicensed.

3. No state license number visible. Every legitimate direct lender is licensed in your state and displays their NMLS number and state license. If you can't find these on their site, verify at nmlsconsumeraccess.org before signing. Every lender in our network is licensed in your state.

4. Pressure to sign immediately. "This offer expires in 15 minutes!" is manipulation. Real lenders give you the full Truth in Lending disclosure and time to read it. Any pressure to sign in seconds is a scam signal.

5. APR isn't disclosed prominently. Federal law (Truth in Lending Act) requires the APR to be disclosed clearly BEFORE you sign. If APR is buried, vague, or missing, don't sign.

6. Payments taken by wire transfer, gift cards, or cryptocurrency. Legitimate lenders use ACH (bank-to-bank transfer) or debit card. Any request for wire transfers or gift cards is fraud.

7. "You've been pre-approved!" texts from lenders you didn't apply to. Real lenders don't cold-solicit pre-approvals via text. These are lead-gen scams that harvest your data and sell it (or worse).

8. No physical address. Every legitimate lender has a physical business address in the US. Offshore and unlicensed tribal lenders often hide their address or list a PO box in a state with lax rules.

9. Extreme APRs (500%+). Unlicensed tribal or offshore lenders often charge 500-800% APR, claiming immunity from state usury laws via sovereign nation status. These loans are legally questionable in most states and financially devastating.

What LEGITIMATE lenders always do

  • Display NMLS ID and state license visibly
  • Show your APR before you sign
  • Give you the Truth in Lending disclosure PDF to download
  • Deduct origination fees from proceeds (never asked separately)
  • Use ACH for both deposit and repayment
  • Report to at least one credit bureau (installment loans, not payday)
  • Provide a customer service phone number that a human answers
  • Allow you to review the full loan agreement for at least 24 hours if you request

Where to verify a lender

Federal: nmlsconsumeraccess.org — every consumer lender should have an NMLS ID.

State: your state's Department of Financial Institutions or Department of Banking website. Every state has one.

Complaint database: consumerfinance.gov/complaint — see if the lender has complaints filed.

BBB: bbb.org — not perfect, but useful for seeing patterns of complaints.

What to do if you've been scammed

1. Contact your bank IMMEDIATELY to reverse any ACH withdrawals from unauthorized lenders.

2. Freeze your credit at all three bureaus (Equifax, TransUnion, Experian). This blocks any further identity theft.

3. File a complaint at consumerfinance.gov/complaint and with your state Attorney General.

4. Never pay a "recovery fee" to someone claiming they can get your money back. That's a second scam targeting scam victims.
